Form 8843 Statement for Exempt Individuals and Individuals with a Medical Condition, is used to exclude days of presence in the U.S. for certain individuals. The form needs to be filed with your Form 1040-NR U.S. Nonresident Alien Income Tax Return., and if you don't need to file a return, send the form to the IRS.

Per IRS Publication 519 U.S. Tax Guide for Aliens, page 6:

Form 8843. If you exclude days of presence in the United States because you fall into any of the following categories, you must file a fully completed Form 8843.

  • You were unable to leave the United States as planned because of a medical condition or problem.
  • You were temporarily in the United States as a teacher or trainee on a “J” or “Q” visa.
  • You were temporarily in the United States as a student on an “F,” “J,” “M,” or “Q” visa.
  • You were a professional athlete competing in a charitable sports event.

Attach Form 8843 to your income tax return. If you do not have to file a return, send Form 8843 to the following address.

You must file Form 8843 by the due date for filing Form 1040-NR. The due date for filing is discussed in chapter 7.


To enter information for Form 8843 in the TaxAct program:

  1. From within your TaxAct return (Online), click the Tools dropdown, then click Forms Assistant.
  2. Click + next to the FEDERAL Forms manila folder (if it is not already expanded), then click + next to the Forms & Schedules manila folder (if it is not already expanded).
  3. Scroll down and click Form 8843 - Statement for Exempt Individuals and Individuals with a Medical Condition, then click + Add.
  4. Continue with the interview process to enter your information.
  1. From within your TaxAct return (Desktop), click Forms in the options bar.
  2. Click Federal from the dropdown in Forms Explorer, then click the Forms & Schedules dropdown (if it is not already expanded).
  3. Scroll down and click Form 8843 - Statement for Exempt Individuals and Individuals with a Medical Condition, and it will appear in Forms View.
