You cannot use the current-year TaxAct program to file a return for a different tax year. Texas labels its franchise tax forms by the year the report is filed, not the year being reported.
For example, 2025 taxes are filed in 2026, so Texas labels those forms for 2026. TaxAct programs are labeled differently. The 2025 TaxAct program is used to file 2025 taxes, even though those returns are filed in 2026. Because of this, you would use the 2025 TaxAct program to file the Texas Franchise Tax Report that includes Form 05-158-A, 2026 Texas Franchise Tax Report.
Prior Year
If you need to file a 2025 report (prior year), you will need to use the forms and instructions available on the Texas Franchise Tax Forms website or use the TaxAct program for that report year. Review the available return years on the Access Prior Year Tax Returns webpage.
Due Date
The Texas Franchise Tax Report is due May 15 of the filing year.
Webfile Number
To file, you must enter a valid Webfile number. If you do not have this number available, contact the Texas Comptroller at (800) 442-3453 to request a duplicate notification letter or retrieve it over the phone, after verification. See the TX Comptroller website for details.
Forms to File
Two forms are used for the Texas Franchise Tax Report.
- To generate Form 05-158-A, Texas Franchise Tax Report, for reports originally due on or after January 1, 2026, the entity must have over $2,650,000 of reportable income, entered at the federal level.
- For entities reporting less than the $2,650,000 threshold, you will be directed to file Form 05-169, Texas Franchise Tax EZ Computation Report.
In addition to the Texas Franchise Tax Report (either Form 05-158-A or 05-169), you must also complete one of the following, depending on your entity type:
- Form 05-102, Texas Public Information Report - If the entity is a corporation, limited liability company, professional association, limited partnership, or financial institution.
- Form 05-167, Texas Ownership Information Report - If the entity is other than a corporation, limited liability company, professional association, limited partnership, or financial institution.
TaxAct Online
Texas Franchise Tax Report
To generate a Texas Franchise Tax Report using TaxAct Online, follow these steps.
- Enter the required federal information first. Federal entries transfer to the Texas return automatically, when applicable.
- Go to Texas, then select Basic Information.
- Continue through the interview until you reach Texas - Filing Report.
- Select the appropriate report type:
- Annual Report
- Final Report
- Review all transferred information carefully to be sure it is complete and correct.
Note: 1040 Texas Returns are not available online.
Form 05-102
- Go to Texas, then select Basic Information.
- Continue through the interview steps until you reach the question Texas – Entity Type.
- Answer Yes to the question about whether the entity is a corporation, limited liability company, professional association, limited partnership, or financial institution.
- Return to the Texas state interview.
- Select the drop-down for Texas Public Information Report.
- Complete each section listed in the drop-down to avoid any errors.
Form 05-167
- Go to Texas, then select Basic Information.
- Continue through the interview steps until you reach the question Texas – Entity Type.
- Answer No to the question about whether the entity is a corporation, limited liability company, professional association, limited partnership, or financial institution.
- Return to the Texas state interview.
- Select the drop-down for Texas Ownership Information Report.
- Complete each section listed in the drop-down to avoid any errors.
TaxAct Desktop
Texas Franchise Tax Report
If you are using the desktop program, use Forms View to complete the Texas return.
- Open the program and select Forms in the upper-left corner next to Q&A.
- Select Add/Remove States and add Texas.
- Complete the necessary federal entries, including income and deductions. Federal entries transfer to the Texas return automatically, when applicable.
- Note: If you are filing a 1040 Texas tax return, you must file a Federal Schedule C to complete the Texas Franchise Tax Return.
- After completing the federal data entry, select the drop-down for Texas.
- Select Forms and Schedules.
- Select the Texas Franchise Tax Report and complete the required entries.
- In the Select Type of Report section, choose either:
- Annual Report
- Final Report
- Review the form and all related entries for accuracy.
Note: If you are filing a Texas franchise tax return with a 1040 return, be sure to select the applicable single-member LLC from the federal return so the correct information transfers to Texas.
Form 05-102
- Under Forms and Schedules, select Form 05-102 – Texas Information Report.
- Fill out the form as completely as you can.
- Under sections A, B, and C, click Select envelope to open supporting documents.
- Click the text for each section and complete each worksheet.
- Review Form 05-102.

- Under Forms and Schedules, select Form 05-167 – Texas Ownership Information Report.
- Fill out the form as completely as you can.
- Under sections A and B click Select envelope to open supporting documents.
- Click the text for each section and complete each worksheet.
