Oregon - American Indian Income Subtraction (Code 300)

TaxACT supports the entry of the subtraction code and the amount on Line 18 of Oregon Form 40 (Line 37 of Form 40N or 40P), but does not support the Exempt Income Schedule for Enrolled Members of a Federally Recognized American Indian Tribe which needs to be sent with the return. You would need to manually complete the form and paper file the return. You can obtain the form and the instructions on the Oregon website Exempt Income Schedule for Enrolled Members of a Federally Recognized American Indian Tribe.

To enter the subtraction code and amount in the TaxACT program:
  1. From within your TaxACT return (Online or Desktop) click on the State Q&A tab, then click Oregon bellow the blue tabs
  2. Click Income to expand the category, then click Other Subtractions from Income
  3. On the screen titled Oregon - Other Subtractions, select American Indian and enter the amount
This information will transfer to Line 18 of Oregon Form 40 (Line 37 of Form 40N or 40P).

Other subtractions

American Indian [code 300]. Are you an enrolled member of a federally recognized American Indian tribe? You may be able to subtract all or part of your income if all of the following are true:
  • You are an enrolled member of a federally recognized American Indian tribe, and
  • Your income was from sources within federally recognized Indian country in Oregon, and
  • You lived in federally recognized Indian country in Oregon when the income was earned.

You must attach a completed copy of your Exempt Income Schedule for Enrolled Members of a Federally Recognized American Indian Tribe to your return. Download the schedule from Oregon's website or contact the state to order it.
